Terms of Service

1. Agreement to these Terms
These Terms of Service (the “Terms”) govern your access to and use of Stormy CMS, including our websites, dashboard, content APIs, SDKs, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization.
2. The Service
Stormy CMS is a headless content management system. The Service lets you create sites, manage content and media, collaborate with team members, and deliver content to your own applications through our APIs and SDKs. We may improve or modify the Service over time, and we will not materially reduce the core functionality of your active subscription during a paid term.
3. Your Account
You sign in to Stormy CMS using a supported identity provider (such as GitHub or Google). You are responsible for safeguarding access to your account and for all activity that occurs under it. You must provide accurate account information and keep it up to date. You must be at least 16 years old to use the Service.
4. API Keys and Credentials
The Service issues credentials for your sites, such as client IDs and client secrets. You are responsible for keeping secrets confidential and for all requests made with your credentials. If you believe a credential has been compromised, you should reset it from your dashboard immediately.
5. Subscriptions and Billing
Paid plans are billed on a recurring subscription basis. Payments are processed by our payment provider, Stripe; we do not store your full payment card details. Team seats are part of your subscription and can be adjusted from your dashboard, with charges prorated or adjusted according to your plan. Unless required by law, fees are non-refundable. If a payment fails, we may suspend or limit access to the affected site until payment is resolved. We may change our prices with reasonable advance notice; changes take effect at your next renewal.
6. Your Content
You retain all rights to the content you create, upload, or store in the Service (“Customer Content”). You grant us a limited license to host, store, process, and transmit Customer Content solely as needed to provide the Service. You are responsible for your Customer Content, including having the rights necessary to use it and ensuring it does not violate any law or third-party rights.
7. Acceptable Use
You agree not to:
- use the Service for any unlawful purpose or to store or distribute unlawful content;
- attempt to probe, breach, or circumvent the security or authentication measures of the Service;
- access accounts, sites, or data that do not belong to you;
- interfere with or disrupt the Service, including by circumventing rate limits or usage restrictions;
- resell or redistribute the Service itself without our written permission; or
- use the Service to send spam or distribute malware.
8. Team Members
You may invite others to collaborate on your sites with roles such as admin or contributor. You are responsible for the actions of the people you invite and for managing their access. Invited users must also comply with these Terms.
9. Intellectual Property
The Service, including its software, design, and documentation, is owned by Stormy CMS and its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights in the Service. Feedback you provide about the Service may be used by us without restriction or obligation to you.
10. Termination
You may cancel your subscription or delete your account at any time from your dashboard. We may suspend or terminate your access to the Service if you materially breach these Terms, if required by law, or if your use poses a security risk to the Service or others. Upon termination we will make reasonable efforts to allow you to export your Customer Content for a limited period, after which it may be deleted.
11. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
12. Limitation of Liability
To the maximum extent permitted by law, Stormy CMS will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total liability for all claims arising out of or relating to the Service will not exceed the amounts you paid to us for the Service in the twelve months preceding the claim.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide notice, such as by email or a notice in the dashboard, before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
